These aren't documents for later. Capacity can be lost suddenly — through accident or illness — and by then it is too late to put an LPA in place.

No LPA — the Court decides

If you lose capacity without an LPA, your family cannot simply step in. They must apply to the Court of Protection for a deputyship — a process that typically takes months, involves ongoing supervision and fees, and may not appoint the person you would have chosen.

No Will — the rules decide

Die without a valid Will and the intestacy rules dictate who inherits your estate. Unmarried partners receive nothing automatically. Step-children are not included. The outcome frequently bears no resemblance to what the person would have wanted.

Errors — rejection and delay

The Office of the Public Guardian rejects LPA applications for small mistakes — a signature in the wrong order, a date out of sequence, a missing witness. Each rejection means starting again: more delay, and another registration fee at risk.

The good news: all of this is avoidable. Both documents can usually be put in place in a matter of weeks, and we handle the detail so nothing is left to chance.

Common questions

Questions we hear most often.

They cover different things. A Property & Financial Affairs LPA lets your attorneys manage money, property, and bills. A Health & Welfare LPA covers decisions about care, treatment, and where you live — and only takes effect if you lose capacity. Most clients put both in place at the same time, because losing capacity affects both areas of life at once.
A Health & Welfare LPA can only be used once you have lost capacity. A Property & Financial Affairs LPA can be set up so your attorneys may act as soon as it is registered — with your consent while you still have capacity — which many people find practical, or restricted to use only after capacity is lost. We talk this through and set it up the way you want.
People you trust completely — commonly a spouse, adult children, or close family. You can appoint more than one, decide whether they act jointly or independently, and name replacements in case an attorney can no longer act. Choosing well matters more than most people expect, and it is a core part of our initial conversation.
An LPA must be registered with the Office of the Public Guardian before it can be used, and registration commonly takes several months. That is exactly why acting early matters — an LPA prepared today is ready long before it is ever needed. We track the registration and keep you informed throughout.
If your circumstances have changed since it was written — marriage, divorce, children, property, a business — then very possibly. Marriage generally revokes an earlier Will entirely, which surprises many people. We review existing Wills and advise plainly on whether anything needs updating.
